ExpressVPN Faces Lawsuit Over Alleged Auto-Renewal Violations

ExpressVPN is facing a class action lawsuit in California after customer Timothy Millar claimed he was charged a monthly fee without his consent. Millar says he signed up in September 2022 for what he believed was a one-time purchase, but after the plan ended, ExpressVPN automatically enrolled him into a monthly subscription. He alleges this violated California’s Automatic Renewal Law, which requires companies to clearly disclose auto-renewal terms and obtain explicit consent. The lawsuit also accuses ExpressVPN of false advertising for misleading customers about these auto-renewals.

ExpressVPN has responded by stating it takes the matter seriously and plans to defend its auto-renewal policy. “ExpressVPN has always prioritized transparency and giving users clear information about pricing, billing, and auto-renewal,” a spokesperson said. They emphasized that users can turn off auto-renewal or cancel their subscription through their account dashboard or by contacting support.

This case comes as part of a wider trend in the VPN industry, considering NordVPN is also being sued over similar auto-renewal practices. A law firm has filed multiple complaints on behalf of former customers, and has investigated other VPN providers like Proton VPN and Private Internet Access. Although no lawsuit has been filed against those companies, the legal actions highlight growing scrutiny over how VPN services manage subscriptions.

It remains unclear whether these legal challenges will change how top VPN providers handle auto-renewal policies. For consumers seeking alternatives, some VPNs, such as Mullvad, which discontinued recurring subscriptions in 2022, offer one-time payments without automatic renewal.
